TERMS OF SERVICE
1. We offer design services for a new website. Our designs may be used for the CMS (content management service/hosting) provided only. They may not be sold/resold or traded in any manner.
2. Our designs are our copyright - all other items are third party tools and partners that we use for our design services. Client takes possession of design and may use design for their personal/commercial website, but the design may not be transferred/sold in any manner.
3. We shall not be held liable in any manner for any actions taken by our third party providers.
4. You, the client will provide us with reliable contact information. We will not be held liable for anything that occurs due to lack of communication or an inability to reach the client.
5. You understand and agree that our designs and CMS are provided "as-is" and Created Website Design assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. You, the customer/client are responsible for your content and the storage of your content. We recommend backing up your content often.
6. The use of the CMS is determined by third party rules. You are responsible for keeping your payments current. Non payment may result in the CMS provider's right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).
7. You are responsible for maintaining your password and account. Created Website Design will not be held responsible for any content on websites built for clients.
8. Price quotes may be changed according to added requests/features, etc., made by the client.
9. Payment for website design and monthly payments are separate payments. We provide website design services only, and as such, payment is for the service of designing your website. We offer no refunds since we are providing a service. We build our designs on content management systems that are the easiest to use where millions are using said service and easy to follow help and instructions. Inability by client to use website shall in no way, shape or form provide any reason for a refund. Once website is edited/changed by client, especially, but for any reason, there is no refund for the service of designing the website.
10. You agree to indemnify and hold Created Website Design, and its parent company, subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another and/or for any reason at all.
11. Created Website Design shall not be held liable in any manner for your use of our services or any complaint of any kind arising from your use of our services.
12. Our design services are separate from any content management system, hosting, etc. In cases where hosting is provided for stated amount of time, only fee paid is offered with no association or guarantee of third party hosting or system, etc. Created Website Design shall not be held liable or responsible for third parties even when fee was provided for that service. Only the fee is offered not association or guarantee with/of third party services.
13. In the event that client changes/adds/deletes or ruins a design, we shall in no way or manner be held responsible for that client's actions. Client is wholly responsible for fixing any actions on their part, including new features introduced into the website design.
14. We reserve the right to update or change our terms of service and all new services offered will be under our terms of service.
